Don Henley Beats Malicious Prosecution Suit Tied to Stolen Eagles Lyrics Dispute

Don Henley Cleared in Malicious Prosecution Lawsuit Over Stolen Eagles Lyrics Dispute

A New York State Supreme Court judge has dismissed a malicious prosecution lawsuit filed by Glenn Horowitz, a rare books dealer accused of trying to sell stolen copies of handwritten Eagles lyrics. The decision comes after prosecutors abandoned the criminal case last year due to new information and lack of confidence in its merits.

Horowitz had sued Don Henley, the Eagles' songwriter, and longtime manager Irving Azoff, alleging they had maliciously prosecuted him over the dispute. However, Judge Kathleen Waterman-Marshall granted their motion to dismiss the suit, stating that the Manhattan District Attorney's Office had "ample probable cause" to pursue a criminal case against Horowitz.

Waterman-Marshall also noted that none of the documents released during the trial exonerated Horowitz, and the prosecution's dismissal was based on the inability of his defense team to present certain information. She added that there was no finding that this information was withheld by Henley or any other defendant for an improper purpose.

Henley's lawyer, Dan Petrocelli, hailed the decision as a victory, saying "The only malicious prosecution was Horowitz's own lawsuit, which the Court promptly and rightly dismissed." Horowitz, however, plans to appeal the decision and reargue against Henley and Azoff.

The dispute began when Kosinski and Inciardi tried to sell excerpts from the lyrics on several occasions, prompting Henley to file a report with the Los Angeles Sheriff's Department. The Manhattan DA's office eventually got involved, and Horowitz claimed that Henley had pursued and materially assisted in his prosecution by making false statements to law authorities.

However, Judge Waterman-Marshall ruled that Henley's report to law enforcement did not constitute intentional infliction of emotional distress, which is the claim underpinning Horowitz's lawsuit. The case remains ongoing, with Horowitz still pursuing a malicious prosecution suit against the city of New York and Henley seeking to reclaim the lyrics sheets.

The handwritten notes, which include over 100 pages of allegedly stolen drafts of songs from the Eagles' "Hotel California," have remained in the custody of the Manhattan DA's office. A decision on their rightful ownership is pending.

I gotta say, this whole thing just smells like a big mess πŸ€”. I mean, come on, Glenn Horowitz thinks Don Henley and Irving Azoff are trying to silence him? It's all just a bunch of drama and overblown egos πŸ’β€β™‚οΈ. If you ask me, Horowitz should've thought twice before trying to sell those stolen lyrics in the first place πŸ€¦β€β™‚οΈ.

And let's be real, even if Henley did file that report with the cops, what's the worst that could've happened? It was just a bunch of notes from a songwriting session. I'm not buying all this emotional distress nonsense πŸ˜’. Horowitz is basically trying to pin all his problems on someone else and get rich off it πŸ’Έ.

I'm not saying Henley or Azoff are perfect, but come on, folks! This whole thing just looks like a big waste of time and resources πŸ•°οΈ. I'm rooting for the city of New York in this one πŸ‘Š.

I'm a bit surprised by this ruling πŸ€”. While it makes sense that Don Henley and Irving Azoff would not want to be implicated in Horowitz's malicious prosecution, I think it's interesting that Judge Waterman-Marshall acknowledged the lack of exonerating evidence for Horowitz 😐. It's also telling that Horowitz plans to appeal, suggesting that he still believes there's some merit to his claims πŸ’β€β™€οΈ.

From an intellectual perspective, this case highlights the challenges of balancing artistic ownership and intellectual property rights 🎢. The fact that Horowitz was able to sell excerpts from the lyrics without Henley's permission raises questions about the limits of fair use and the role of law enforcement in these disputes πŸ”.

I feel like this whole thing is just a bunch of drama 🀯! Don Henley and Glenn Horowitz should've worked things out instead of going to court over it. It's not like the lyrics are gonna change anyone's life or anything πŸ™„. And now Horowitz is planning to appeal? Come on, dude... you lost in court πŸ˜‚. I guess it just goes to show that even with new info, cases can still be tricky. Maybe they'll settle eventually and we'll all just move on from this πŸ€·β€β™‚οΈ

I think it's totally understandable that Don Henley would want to protect his creative work and intellectual property πŸ€”. I mean, can you imagine if someone just started selling your unpublished novel or song lyrics without even asking for permission? It'd be a nightmare! And in this case, Horowitz's rare books dealer background makes me think he might've had an ulterior motive - maybe trying to make a quick buck off the Eagles' iconic songs πŸ€‘. But hey, I'm not taking sides here... it's all about understanding the artist's perspective and the importance of preserving their original work πŸ’ͺ.

I'm low-key shocked that Horowitz didn't win this one 🀯 He totally played dirty, and I mean who tries to sell stolen lyrics for a quick buck? Not cool, dude πŸ€‘ The fact that Henley did nothing but report the issue to authorities and he still gets sued for it is wild. And now Horowitz is appealing again... like, come on man, just move on from this already πŸ’”

omg what a relief! don henley must've been going crazy with all that drama πŸ˜… i mean, who tries to sell stolen eagles lyrics? and now he gets to breathe easy again πŸ™Œ it's kinda sad that glenn horowitz is still going on about this though, like seriously, move on fam πŸ€·β€β™€οΈ

idk why Glenn Horowitz even bothered suing Don Henley... I mean, come on! If he really thought he had a legit case, wouldn't his lawyer just try harder to prove it? Sounds like a huge waste of time & money to me πŸ€¦β€β™‚οΈ. And btw, if you're gonna sell "stolen" copies of song lyrics, that's just basic theft... you can't get mad when the original owner is trying to protect their work πŸ’―.

I mean what even is going on with this guy Glenn Horowitz? He tries to sell some old lyrics and suddenly he's suing Don Henley for like a million bucks? 🀯 And now the court is basically saying "nah, your claim was weak from the start" πŸ‘Ž. I get that you might think it's unfair to be sued by someone who's trying to make money off your work, but come on man... if you're gonna do something shady, at least have the decency to own up to it. πŸ™„ The fact that he's planning to appeal this decision just shows how much he's dug in his heels... I don't think he's going to win this one 😊.

I gotta say πŸ€”, I'm really disappointed that Glenn Horowitz couldn't come to a peaceful resolution with Don Henley and Irving Azoff. It's not like Henley did anything wrong, you know? He just tried to protect his work from some shady dealers trying to flip rare lyrics for profit πŸ˜’. The fact that the court ruled in his favor kinda shows that the DA's office didn't have a solid case against Horowitz anyway πŸ€·β€β™‚οΈ. And let's be real, if Horowitz was so sure he wasn't doing anything wrong, why did he file a lawsuit against Henley and Azoff in the first place? πŸ€‘ I mean, I get it, we're all entitled to our opinions and whatnot, but sometimes you gotta take responsibility for your actions πŸ’―. Anyway, I hope Horowitz reconsiders his decision to appeal – maybe this is an opportunity for him to reflect on how he can make amends and move forward 🀞

OMG I CANT BELIEVE THIS LATEST DEVELOPMENT!!! 🀯 DON HENLEY IS FINALLY FREE FROM ALL THOSE FALSER LAWSUITS!!! IT JUST GOES TO SHOW THAT YOU CANT SUE PEOPLE FOR TRYING TO PROTECT THEIR WORK AND INTELLECTUAL PROPERTY!!! DAN PETROCELLI MUST BE DANCING ON THE CEILING RIGHT NOW!!! πŸ•ΊπŸ» I DONT KNOW ABOUT HORWITZs NEXT MOVE BUT HE BETTER WATCH HIS BACK OR HE COULD BE FACING EVEN MORE TRASH TALK FROM HENLEY AND AZOFF!!! 😏

"Life is what happens to you while you're busy making other plans." πŸŒͺ️

I think Don Henley and Irving Azoff are breathing a sigh of relief now that this lawsuit has been dismissed, but I'm not surprised Horowitz is planning to appeal. It's gonna be a long and costly battle for him. And can we talk about the irony of someone accusing others of malicious prosecution while trying to sell stolen lyrics? The tables seem to have turned quite literally!

omg u guyz i just cant even lol so like don henley is finally cleared of all these allegations about him trying to ruin glenn horowitzs life over stolen eagles lyrics and idk how he even got into this situation in the first place πŸ€” anyway so horowitz was selling these allegedly stolen drafts of songs from "hotel california" on the black market and don henley reported it to the cops and now horowitz is trying to sue him for malicious prosecution but apparently the judge felt like lenny lenardo wouldnt do anything wrong πŸ˜‚ and honestly im kinda glad cuz who tries to steal song lyrics from don henley?? 🀣

I'm so done with all these crazy lawsuits 🀯! Don Henley and Irving Azoff are finally clear, but what a wild ride it was πŸ˜‚. I mean, can you imagine trying to sell stolen Eagles lyrics? Like, what's next? Trying to flog bootlegged Beatles albums? 🎸

And seriously, Glenn Horowitz thought he could take on Don Henley and Irving Azoff in court? Please πŸ™„. It's like he thought the songwriting gods would intervene on his behalf... Newsflash: they didn't πŸ˜‚.

I do feel bad for Horowitz, though - he got burned by not being able to present certain info during the trial. You gotta give him points for trying, but maybe next time he should stick to buying rare books rather than trying to cash in on celebrity drama πŸ“š.

The real winners here are Don Henley and Irving Azoff - they can finally get their lyrics back and move on with their lives. And let's be real, the handwriting on the wall (pun intended) was always going against Horowitz πŸ˜‚.

πŸ˜’ just another example of how these musicians get taken advantage of by people trying to make a quick buck... i mean, who tries to sell stolen lyrics? and now don henley's being sued for trying to protect his work... like, hello, he's the one who wrote the songs in the first place πŸ€·β€β™‚οΈ and what really gets me is that glenn horowitz thinks he's got a case against him? please, dude, you were just trying to scam people out of their cash πŸ’Έ and now you're complaining about being sued... πŸ™„

omg i cant even... so like what even is going on with these lyrics sheets? 🀯 theyre just sitting there in someones custody and no one can agree on who owns them? its like, can we just figure out whos songs are whos already?! πŸ™„ and btw what would happen if someone tried to sell those notes without knowing the story behind them? would it be like selling a piece of history or something?

Ugh πŸ˜’ just saw that Don Henley got cleared in that lawsuit about those stolen Eagles lyrics... like, what even is the point? πŸ€·β€β™‚οΈ Some rich dude's rare books deal went sour and now he's trying to sue everyone involved for millions πŸ’Έ meanwhile, the real question is: where are those handwritten notes gonna end up?! πŸ“ The Manhattan DA's office has 'em locked away still... just a whole lot of drama over some song lyrics 🎢

idk why glenn horowitz even bothered with this lawsuit πŸ€·β€β™‚οΈ, like don henley and irving azoff were just trying to protect their lyrics and whatnot. prosecutors already dropped the criminal case last year, but he still thinks he can take down henley in court? πŸ™„ not buying it. now horowitz's gonna appeal and try again... maybe he should just stick to selling rare books or whatever πŸ“šπŸ‘€

I gotta say, I'm all about giving Don Henley a pass here πŸ™Œ. The whole thing with Glenn Horowitz seems super fishy to me. I mean, who tries to sell stolen lyrics? That's just not right. But at the same time, I can see why they'd wanna crack down on him - it's like, intellectual property and all that jazz πŸ’Ό.

I don't think Henley did anything wrong by reporting the thing to the cops, even if he might've made a few "mistakes" along the way πŸ€¦β€β™‚οΈ. The fact is, Horowitz's whole lawsuit just seems like a pretty weak attempt to get back at him πŸ˜’.

And can we talk about how crazy it'd be if someone actually managed to appeal their way out of getting in trouble for stealing lyrics? Like, what even is that 🀯? I'm sticking with my man Don Henley on this one πŸ‘.

Can you believe this guy Horowitz? He thinks he can just sue Don Henley and Azoff for trying to protect the rights of their work? The court was like "nope, you're the one who's been trying to sell stolen lyrics". And now Horowitz wants to appeal, like that's gonna change anything. 🀣 I mean, come on, he got his day in court and lost big time. Now it's time for him to take a hike. The Eagles' songwriting team didn't do anything wrong, they just wanted to protect their intellectual property. And yeah, Henley's lawyer is on point with that "the only malicious prosecution was Horowitz's own lawsuit" lol. This whole thing is just a waste of time and resources for everyone involved. πŸ™„
